Due diligence (debida diligencia)
Definition
In a Panama real estate purchase, due diligence is the legal and physical verification before closing: title and liens at the Public Registry, clearance certificates, the condition of the PH, actual measurements and, in pre-construction, the developer's solvency. It happens before you pay, not after.
In practice
The typical cost — legal fees around 1%–1.5% of the price — is the cheapest insurance in the deal. A complete due diligence in Panama City takes a few days to two weeks and answers four questions: is the seller the owner? Is the finca unencumbered? Are the bills current? Does what I'm buying match what's recorded? In pre-construction, add: the developer's delivery track record and the promise contract's terms.
