Possession rights (derecho posesorio)
Definition
In Panama, possession rights (derecho posesorio) are the recognized occupation of state land without a recorded ownership title. They are bought and sold, but they are not full ownership: they aren't recorded as dominion at the Public Registry, and their legal security depends on certifications and actual possession.
In practice
It's common on islands, coasts, and rural land — and it's where foreign buyers err most, because listings rarely make it clear. A possession right can be legitimate and even titleable with the correct process, but it demands specialized legal review: certifications from the competent authority, transfer history, and on-site verification. It doesn't apply to the Panama City residential market we work, where titled property is the standard. Simple rule: a surprisingly cheap island price = first ask what right is being sold.
